Ok i bought my car off a friend for $2000, we are good friends so he let me make payments on it to him, it did not run so at the time the title was no big deal @ the time well now it is running and it has been paid for for a while now but still no title. I keep getting that the title is at the insurance company due to the gap coverage that was on the car, I guess how much longer do i keep being nice about this? I prob. should have been a dick long before now, should i keep trying to get the title or tell him i want my $2000 back and take all of the stuff ive put on it off?

Insurance companies don't hold titles for cars UNLESS the vehicle was a total loss and they paid off a lienholder or the title was signed over because a claim was paid out (total loss). GAP insurance only pays when a vehicle is totalled also.

Is it a salvage title? If so, you are probably screwed by a "good friend"

the car was in his moms name and she had a medical condition and cant work now, which is why he told me the car was paid off. he said he has to send the insurance company 250 dollars im assumeing its a deductable of some sorts.

I think he is pulling your leg. Unless that car was used as a judgement in an accident they had without insurance, I can not see any way for them to be holding the title.

That doesn't make any sense. They would have no interest in the title for the car if they had no interest in the car... Insurance companies aren't title holding companies and are not "lienholders" so they would have no reason to have the car title without the car...

$250.00 sounds like a deductible but it still doesn't add up as to why they would have the title.

Sounds like a salvage title and he has to buy back the car from the insurance company. If the car wasn't wrecked or had water damage it sounds like you need to do a few things. Be a dick to your buddy, call the insurance company, and post the vin so someone can run a car fax on it a get you some answers.

If she is or was sick and had disability insurance on the loan for the car they may have paid the loan off for her minus a $250 deductible. Now she has to wait for the lien of the bank to be cleared off by the insurance company that paid the loan off.

That is the only way I can see an insurance company having the title.

No, they still would not get the title from the bank for that purpose. Credit Life and Disability insurance has nothing to do with the title. When you have a loan, the bank holds the title. If the L&D insurance paid off the loan, they would then release the title to the customer. The only reason I can see the insurance company would have the title is because they deemed the vehicle a "Total Loss"

I'd bet the insurnace company does not have the title and it's just a story but wh knows!

It has been forever, I did just get it April 4, not real sure where it was, I told home that the car was tuned and I needed it. Long story short he had a release faxed to the DMV and had a duplicate made so I could get it .
