I am Harley and Guns wife Cathy and I would like to clear a few things up if I may. My husband was charged with Obstruction of Official Business because he was Open Carrying in WalMart when a police officer approached him and I and immediately demanded to see his CHL. My husband told him that OC did not require a CHL. He then demanded to see a state issued ID from him, and my husband immediately verbally identified himself to the cop. As a matter of fact, the cop demanded to see a state issued picture ID 3 or 4 times and each time Bill verbally identified himself and finally he produced a drivers license at about 33 seconds into the encounter according to the video tape of the encounter. You can clearly see him handing the drivers license over to the cop at approximately 33 seconds. He then informed us that WalMart was posted no guns and my husband corected him and even the store security people told the cop that he was wrong.

Stuff deleted read at site

Please keep us in your thoughts and prayers that this ends in a good way for Bill and that he gets justice in a town thats known for doing things their own way

Here is a little snippet of which I am referring to. I sincerely apologize for being so long but I felt that this needed to be said and the air needed to be somewhat cleared and let people know what we are facing.....Thanks again.....Mrs Harleys&Guns

Apparently they haven't had a jury trial in 4 years!!

They are just stringing this guy on trying to get him to drop case... my opinion!!

Im from waverly, the prosecutor over here Rob Junk does not like to go to trial over anything. He will drop his pants at the last minute everytime to avoid a trial. Ive seen him do it over and over again as a police officer and a once when my ass was in the hotseat. He starts off all gung ho and as time goes on and other stuff starts stacking up he usually drops stuff or at least pleas it down to nothing. A good firebreathing defense attorney can make him look like a horses ass with minimal effort.

Went back up for try # 2 for a trial FAIL on May 27th... I went up for support, only had 13 jurors show up..... One was arrest on the spot, for a warrant, one couldn't hear, one was on Meds... on and on...

Try #3 will be June 8th ... what a crock!! I'll be going up for that one too!! Should be over 25 of us going up to watch.

what did they charge the guy with? Open carry is legal about the most they can do is ask him to leave or charge him with starting a riot.

They can't charge anyone with inciting a riot just for open carry. Well they can charge them but will not win. Unless you are waving it around of course...

Actually they had no reason to stop him..... I'll be there on June 8th to support him. i think he will get cleared but small town courts can be difficult. My understanding is that the prosecutor wanted to dismiss the charges and the police chief insisted he be charged!! At the first meeting with the prosecutor the officer said he had no RAS reason to stop him. The judge should have thrown it out then, but small towns  sometimes think they make the law not enforce it!!

"At the police station, the cop told me that he was arrested for obstruction for taking too long to produce a photo ID when demanded to by the cop, and was arrested for disorderly for having the audacity to look the cop in the eye when talking to him (cop said that was a threatening maneuver on my husbands part, and that Bill was loud in the store causing a scene, but my husband has some hearing loss in the left ear, and he normally tallks louder and moves his hands when he talks and talking louder is pretty normal for people with hearing loss."
